If I am in an auto accident, who pays my medical bills?
According to Florida law 627.736, Personal Injury Protection (PIP) insurance is the primary payer after a car accident. Even if you have health insurance, your PIP insurance pays first. Remember that you must seek medical care within 14 days of the accident to receive your PIP benefits. If you have extremely serious injuries or car accident injuries that result in permanent injury and/or disfigurement, you can go outside of Florida’s no-fault insurance system to bring your claim against the at-fault party.
Your attorney may approach the other side or their insurance company, for a fair settlement prior to filing suit. Your attorney might also bring your case through the legal system by filing a lawsuit.
